Court Returns Cases Involving Social Media Moderation to Subordinate Courts

On Monday, the Supreme Court overturned earlier decisions regarding two state statutes meant to stop tech companies from barring users for posting potentially harmful content.

This action feeds the ongoing discussion about Republicans’ ability to stop what they perceive as social media giants engaging in “censorship.”

Citing insufficient investigation into whether the content moderation legislation would be illegal in every situation, the Court remanded the case to lower courts for additional consideration.

Legislation from Republican lawmakers has been enacted in Texas and Florida, allegedly preventing tech giants like Google’s YouTube, X, the former Twitter, and Facebook parent Meta from suppressing conservative viewpoints.

While the tech corporations, supported by organisations like NetChoice, contend that the regulations infringe their right to free speech, the states contend that the laws guarantee equitable access to the platforms for all users.
