In a significant win for Apple, an appeals court has temporarily paused an import ban, allowing the company to resume selling the latest Apple Watches. Last week, Apple had halted sales of its Series 9 and Ultra 2 watches in response to an International Trade Commission (ITC) order. The ITC had ruled in October that the blood oxygen sensor in these devices infringed on intellectual property belonging to Masimo, a medical technology company catering to hospitals.
A court filing on Wednesday announced that the motion for an interim stay was granted, temporarily staying the Remedial Orders. Despite the Biden administration’s refusal to pause the ITC ban on Monday, Apple swiftly filed an appeal with the U.S. Court of Appeals for the Federal Circuit on Tuesday. The company is actively seeking a longer stay, and the ITC is expected to respond by January 10.
This development is crucial as it permits Apple to sell the latest models of its highly significant product during the busiest time of the year. Apple Watch sales are a key component of the company’s wearables business, which reported $39.8 billion in sales during Apple’s fiscal year 2023, concluding in September.
