OpenAI Trial Recap: Altman Testifies He Never Promised Musk to Keep the Company a Nonprofit

OpenAI CEO Sam Altman concluded his testimony in the Musk v. Altman trial in federal court in Oakland, California, on Tuesday.

Altman testified for about four hours, discussing his role in founding OpenAI, his relationship with Elon Musk, the company’s structure, and the turbulent days in 2023 when he was briefly removed as CEO.

During his testimony, Altman expressed his dedication to OpenAI, saying, “I had poured the last years of my life into this. I was watching it about to be destroyed.”

Elon Musk filed a lawsuit against OpenAI, Altman, and president Greg Brockman in 2024.

Musk alleges that the company violated its promise to remain a nonprofit and adhere to its charitable mission.

He also claims that the approximately $38 million he donated was improperly used for commercial purposes.

Musk, who co-founded OpenAI in 2015 alongside Altman and Brockman, is seeking to address these alleged breaches.
