The Biden Administration Vetoes the Apple Watch, and the Prohibition on Imports Goes Into Effect

The Biden administration, under U.S. President Joe Biden, has chosen not to intervene and veto a government tribunal’s ruling that bans the import of certain Apple Watches. This decision comes as a result of a complaint filed by medical monitoring technology company Masimo.

Starting from December 26, the U.S. International Trade Commission’s order will prohibit the import and sale of Apple Watches that utilize patented technology for blood-oxygen level monitoring, an addition that Apple implemented in its Series 6 model launched in 2020.

U.S. Trade Representative Katherine Tai, after careful deliberation, has decided not to overturn the ban. Consequently, the ITC’s decision has now been finalized as of December 26.

Despite this ruling, Apple does have the option to appeal the ban with the U.S. Court of Appeals for the Federal Circuit.

In response to the ban, Apple has currently halted the sales of its Series 9 and Ultra 2 smartwatches within the United States. However, it’s important to note that the ban does not affect the Apple Watch SE, a more affordable model, which will continue to be available for purchase. The ban also does not impact the previously sold watches.

Accusations made by Masimo include claims that Apple recruited their employees, unlawfully obtained their pulse oximetry technology, and incorporated it into their immensely popular Apple Watch.
